Terms & Conditions

These terms and conditions are an agreement between the customer ("You" or "Purchaser") and InterVino Pty Ltd ABN 52 106 242 380. Persons under 18 years of age are not permitted to place orders for alcohol.

Below are the terms and conditions under which you may purchase products from InterVino Pty Ltd. Please read the terms and conditions carefully before placing your order.

By completing the customer order form and using InterVino Pty Ltd's services, you agree to be bound by the terms and conditions of this agreement. You also agree to be bound by the terms and conditions of this agreement for orders placed via email, facsimile, regular mail or telephone that are processed manually by InterVino Pty Ltd on your behalf.

You can place an order with InterVino Pty Ltd by:

  1. selecting goods on the intervino.com.au website, entering your personal details along with the recipient details and pressing the "submit" button; or
  2. selecting goods and instructing InterVino Pty Ltd by telephone that you wish to purchase the goods, and providing your personal details along with the recipient details to InterVino Pty Ltd; or
  3. selecting goods and instructing InterVino Pty Ltd by facsimile that you wish to purchase the goods, and providing your personal details along with the recipient details to InterVino Pty Ltd; or
  4. selecting goods and instructing InterVino Pty Ltd by email that you wish to purchase the goods, and providing your personal details along with the recipient details to InterVino Pty Ltd; or
  5. selecting goods and instructing InterVino Pty Ltd by regular mail that you wish to purchase the goods, and providing your personal details along with the recipient details to InterVino Pty Ltd.

Orders will not be accepted until payment is approved or cleared. Placing an order does not constitute acceptance to supply.

An agreement exists between you and InterVino Pty Ltd once an order is received and accepted by InterVino Pty Ltd. Each order is a separate agreement. Each mulitple manual order is a separate agreement per individual delivery.

All orders are processed by InterVino Pty Ltd and are prepared and despatched from outsourced licenced premises.

The price payable for the goods shall be the price applicable on the date the goods are confirmed as ordered. You shall pay for the goods at the time they are ordered. You may use your credit card (Bankcard, MasterCard, Visa, American Express, or Diners Club). InterVino Pty Ltd reserves the right to charge the purchaser a 3% merchant fee for payment made by Amex or Diners cards. Payment by EFT into InterVino Pty Ltd's bank account and cheques may be accepted at our discretion. InterVino Pty Ltd does not accept cash payment for any orders.

InterVino Pty Ltd's prices are subject to variation.

InterVino Pty Ltd aims to include in the product list up-to-date pictures of the goods. At times, the pictures of the goods on the product list are for illustrative purposes only. InterVino Pty Ltd does not warrant the accuracy of the information contained in the product list.

You are licenced to use the InterVino Pty Ltd website on your computer for your use in identifying goods for purchase. You acknowledge that you are not permitted to make any other use of the InterVino Pty Ltd website, or use or copy any of the logos or information that appears on the intervino.com.au website without prior written authorisation from InterVino Pty Ltd.

In the unlikely event that any product or service provided by Intervino Pty Ltd causes illness, injury or death, neither you or your recipient will hold InterVino Pty Ltd or any of its Directors, employees, outsourced suppliers or contractors liable in any way for satisfaction or compensation. InterVino Pty Ltd will of course assist to resolve any such issue wherever possible.

InterVino Pty Ltd may add to, delete, or otherwise change any of the terms of this Agreement. Your use of InterVino Pty Ltd's services after the changes have been made will constitute your deemed acceptance of such changes.

InterVino Pty Ltd reserves the right to disclose information regarding InterVino Pty Ltd members and use of the InterVino Pty Ltd service to third parties providing that the information will not specifically identify you or any personal information supplied by you, except as required in the delivery of your order or in order to rectify technical website issues.

InterVino Pty Ltd may give notice to you by electronic mail or by regular mail to your address contained in the membership registration information provided by you. You may give notice to InterVino Pty Ltd by electronic mail to customerservice@intervino.com.au.

All specials, promotions, offers and discounted items advertised on the intervino.com.au website are available only while stocks last unless otherwise advertised. No special orders are available on specials, promotions, offers and discounted items advertised on the intervino.com.au website.

All prices, specials, promotions, clearances, and discounted items appearing on the intervino.com.au website are applicable for delivery within our Australian delivery boundaries. Refer to the Deliveries page on the website for further details.

Deliveries

In order to purchase goods from InterVino Pty Ltd, the delivery address which you nominate will need to be within a location where InterVino Pty Ltd provides delivery services. InterVino Pty Ltd will advise you if the delivery address nominated by you ceases to be in an area where we deliver goods. InterVino Pty Ltd will not be obliged to continue to deliver goods to your recipient if your recipient changes their delivery address and the new delivery address is not in an area within which we deliver goods. If the goods have already been prepared for delivery or despatched you agree to pay for the costs incurred by InterVino Pty Ltd as oulined below under Cancellations & Refunds. Contact InterVino Pty Ltd if you have any questions regarding our delivery locations prior to placing your order.

Anyone at the delivery address who receives the goods shall be presumed by InterVino Pty Ltd to be authorised to receive the goods.

InterVino Pty Ltd or its duly authorised representative may request that the person who receives the goods at the delivery address provide satisfactory evidence of proof of age. InterVino Pty Ltd will refuse to deliver the goods if the person receiving the goods is unable or unwilling to provide evidence of proof of age. The goods will not be delivered to persons under the age of eighteen (18) years.

InterVino Pty Ltd is required by law to give written instructions to the person responsible for delivery of the liquor, requiring that the liquor be delivered to the adult person to whom the gift is intended, or to another adult person at those premises who undertakes to accept it on behalf of the intended person, in accordance with the customer's instructions, but always to a person over the age of 18 years.

Risk in the goods passes to you upon delivery of the goods to the delivery address. Delivery constitutes either physical delivery to the recipent, physical delivery to another adult person at the property, or goods left on the property by InterVino Pty Ltd or its authorised representative. If a person over the age of 18 years is at the property and refuses to accept the goods on behalf of the recipient, InterVino Pty Ltd will leave the gift at the property.

The price you shall pay for the goods is all inclusive of delivery, packaging and GST as displayed on intervino.com.au. You also agree to pay the extra delivery and handling fee (where applicable) in respect of each order when a delivery point is outside of the InterVino Pty Ltd delivery area, such as Intrastate or interstate, provided InterVino Pty Ltd are able to deliver to your requested location. Refer to the Deliveries page of our website for further information on delivery boundaries and indicative delivery timeframes. Interstate deliveries via Express Post are generally delivered next business day, however some remote Australian locations may take slightly longer. As this is out of InterVino Pty Ltd's control, and as the freight cost has already been incurred by InterVino Pty Ltd, a refund for postage paid is not refundable.

InterVino Pty Ltd will use its best endeavours to ensure that all goods ordered by you are supplied to you or your recipient as per your order. If the goods ordered by you are not available in stock, where possible, InterVino Pty Ltd will supply you with a product of comparable quality (at our discretion) and of equal or greater value. Due to the changing nature of the product it will not always be possible to supply the advertised vintage of a particular product you have ordered. InterVino Pty Ltd reserves the right to supply an alternative, back vintage or next available vintage for substitution to fulfill your order.

Undelivered goods, redeliveries, stolen goods and breakages

For Sydney deliveries where a recipient is not home - unless otherwise advised to return the gift to the point of despatch for redelivery, or redirect the gift to the purchaser's address in Sydney, a calling card will be left for the recipient either under the door or in the letterbox advising the gift has been left in an appropriate location on the property. In the unlikely event the goods are not locatable contact InterVino Pty Ltd for assistance.

For Interstate deliveries where a recipient is not home - in most instances a calling card will be left either under the door or in the letterbox for the recipient to collect the goods from their local post office. If your recipient has not received the goods in a reasonable time, in the first instance request they contact their local Australia Post office to enquire if the goods are being held for them. In the unlikely event the goods are still not locatable contact InterVino Pty Ltd for assistance.

If InterVino Pty Ltd deems your gift undeliverable for any reason, a AU$35.00 redelivery fee will apply for Sydney Metro re-deliveries and standard postal rates for re-deliveries to other areas. You agree to forfeit the undelivered goods to InterVino Pty Ltd with no purchase refund if payment is not made by you to InterVino Pty Ltd for the applicable re-delivery charges. InterVino Pty Ltd enforces this policy in your best financial interests in case the goods for example are stolen.

If the recipient is no longer at the delivery address, or the person delivering the goods feels at their discretion that the goods are not able to be left safely at the property, and likely to be stolen or damaged (eg. apartment blocks), InterVino Pty Ltd will arrange for the goods to be returned to InterVino Pty Ltd at your expense, where the goods will be redelivered to the same address at an agreed future time at your expense, or to an alternative location at your expense. If the recipient is not home, and you have advised InterVino Pty Ltd to leave the goods at the property, and the person delivering the goods feels at their discretion that the goods are not able to be left safely at the property, InterVino Pty Ltd reserves the right to arrange for the goods to be returned to InterVino Pty Ltd at your expense, where the goods can be redelivered to the same address at an agreed future time at your expense, or to an alternative location at your expense.

InterVino Pty Ltd takes great pride and care in preparing your goods for delivery, but are not obliged to replace the goods or refund the purchase price of the goods if they are stolen, broken, deemed missing or undelivered for any reason if to the best of InterVino Pty Ltd's knowledge the goods have been despatched in good order. Please note that your goods are not insured against breakages, or lost or stolen goods. In the unlilkely event your goods suffer a breakage in transit contact us for assistance. Replacement of any goods is entirely at InterVino Pty Ltd's discretion on a case by case basis.

Cancellations, Credits, Refunds and Returns

If at any time either you or the recipient of the gift is not satisfied with the quality of the goods you have purchased or the service provided, you may email InterVino Pty Ltd customer service on feedback@intervino.com.au and a customer service representative will contact you promptly about your concern.

Intervino Pty Ltd recommends you choose carefully from the products available on the intervino.com.au website. Intervino Pty Ltd will allow you to cancel your order provided we have received written notice from you by 2:00pm EST the day prior to the earmarked delivery date. Cancelled orders are subject to a 20% cancellation fee, which is deducted from your refund. Orders cancelled after this time are not subject to a refund.

Alternatively, a full credit is available to you, valid for 6 months from the initial order date of your cancelled order. A credit advice is provided to you in writing by InterVino Pty Ltd and can be redeemed in one order for product available on the intervino.com.au website at any time during this period. Any surplus credit after the re-order is forfeited in this transaction. A credit can be used towards a product purchase of greater value, with the price difference charged to the credit holder.

InterVino Pty Ltd will not provide rainchecks in respect of goods available at ''special'' pricing on intervino.com.au.

InterVino Pty Ltd makes every effort to abide by the next business day delivery policy throughout the Sydney metro area, and the interstate delivery timelines noted on the intervino.com.au order form, however reserves the right to waive a refund if the gift is not delivered within this timeframe due to unforseen circumstances or third party negligence, or due to peak gift giving periods such as Christmas, Valentine's Day, Mother's Day & Father's day where delays can sometimes be expected.

If, within 30 days of delivery, the recipient is not satisfied with the quality of the product ordered by you, they may return the unused portion of the gift (minimum 50% liquid volume) with original entire packaging to Intervino Pty Ltd at PO Box 6372 Alexandria NSW 2015. InterVino Pty Ltd will have the product returned to the supplier for analysis. If it is deemed sub-standard by comparison to other batches from the same maker, InterVino Pty Ltd will offer at our discretion either a full refund to the purchaser, or a replacement product of comparable quality and of equal or greater value to the recipient. All products for exchange are to be picked up by the recipient from InterVino Pty Ltd's nominated supplier/s, and you agree to pay any applicable freight charges.

New South Wales law applies

The laws of New South Wales govern this Agreement.
